Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hoseh Seller platform ("the Service"), operated by Hoseh Technology ("Hoseh Seller", "we", "us", or "our"), a business registered in Malaysia (SSM).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

Hoseh Seller is a seller-side analytics tool. With your authorisation, it connects to your own marketplace shops (Shopee, Lazada, TikTok Shop) using read-only access and shows you your own analytics — including your true profit after platform fees, logistics, and cost of goods, profit breakdowns, and your most and least profitable SKUs.

Today, the profit-analytics dashboard is the live feature. Other capabilities (such as returns, pricing guidance, tax estimation, and invoicing) are described on our website as in development / on our roadmap and may not be available, may change, or may be discontinued. We do not guarantee any particular feature or timeline.

You are responsible for your own marketplace accounts and for your Hoseh Seller account. By connecting a shop, you authorise Hoseh Seller to access that shop's data on a read-only basis through the marketplace's official OAuth flow, solely to provide analytics to you. You confirm you have the right to grant this access.

You are responsible for keeping your account credentials confidential and for activity under your account, and you agree to notify us promptly of any unauthorised access. You may revoke Hoseh Seller's access to any connected shop at any time through that marketplace's Seller Centre / app-authorisation settings.

The Service, including its design, software, and content, is owned by Hoseh Technology and protected by applicable intellectual-property laws. Nothing in these Terms grants you rights in the Service except the limited right to use it as described here.

Your store data and business information remain your property. By using the Service, you grant Hoseh Seller a limited, non-exclusive licence to process your data solely to provide the Service to you. We do not sell, share, or use your data for any other seller. See our Privacy Policy and Data Protection & Security page.

Some features may require a paid subscription in future. Any pricing and payment terms will be communicated clearly before charges are incurred, and price changes will be made with reasonable advance notice.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted or error-free, or that figures will be complete or accurate. Analytics and any guidance are for informational purposes only and are not professional financial, tax, or legal advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Hoseh Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the greater of (a) RM500 or (b) the amount you paid us in the three months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, or death or personal injury caused by our negligence.

10. Indemnification

You agree to indemnify and hold harmless Hoseh Technology and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination & Data on Termination

We may suspend or terminate your access for violation of these Terms or conduct harmful to the Service. You may terminate your account at any time by disconnecting your shops or contacting us at hello@hoseh.app.

On termination or disconnection, we stop accessing your marketplace data and delete all synced marketplace data for the affected shops immediately, and in any event within 14 days, except where retention is required by law. Full details of what we keep and for how long are in our Privacy Policy. You may request export of your data before termination.

12. Governing Law

These Terms are governed by the laws of Malaysia, and disputes are subject to the courts of Malaysia. Nothing in these Terms limits any mandatory consumer-protection or data-protection rights available to you under Malaysian law, which apply regardless of this clause. Where we make the Service available in another country in future, mandatory rights available to you under that country's law are likewise not affected.

13. Changes to These Terms

We may modify these Terms from time to time. We will notify registered users of material changes by email and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
